At the scene

Just crashed? Do these six things.

The first hours decide a lot of injury cases. Save this list, or keep a copy in the glovebox.

After a crashAshby & Rourke
  1. Call 911 and get checked out.Even if you feel fine. Adrenaline hides injuries, and the police report puts the facts on paper.
  2. Photograph everything. Both cars, the plates, the road, the signals, skid marks, and your injuries over the next few days.
  3. Get names and numbers. The other driver’s license and insurance, plus every witness. Witnesses leave fast.
  4. See a doctor within a few days. Some injuries show up a day or two later. An early visit links them to the crash.
  5. Don’t talk to their insurer. No recorded statement, nothing signed. Send the adjuster to us.
  6. Report it to the DMV within 10 days.California requires an SR-1 when anyone is hurt or damage tops $1,000.

How a case works

From the crash to your check.

Most people we meet have never hired a lawyer. Here is the road ahead, mile by mile.

  1. Mile0

    You call

    Day 1

A person answers, day or night. You talk with a lawyer within 24 hours.

  2. Mile1

    We lock down the evidence

    Week 1

Police report, 911 audio, traffic and dashcam video. Some of it is erased within days.

  3. Mile2

You heal. We handle the insurers.

    While you treat

Every call, form and deadline goes through us. We track your bills and lost pay.

  4. Mile3

    The demand

    After treatment

Once your doctors know the full picture, we send a documented demand and negotiate.

  5. Mile4

    You get paid

    Settlement or verdict

If they won’t pay fairly, we file and take it to trial. Our fee comes out of the recovery.

Questions

Straight answers before you call.

Still unsure? A ten-minute call costs nothing and tells you where you stand.

Call (213) 555-0147
How much does it cost to hire you?

Nothing up front. We work on contingency: our fee is a percentage of what we recover, agreed in writing before we start. If we don’t recover money for you, you owe us nothing, including the case costs we paid.

How long do I have to file?

In California, usually two years from the injury to file a lawsuit. If a city, county or state agency was involved, a written claim is due within six months. Evidence fades much sooner, so call early.

What is my case worth?

It depends on your medical bills, lost income, how the injury changes your life and the insurance available. We give you an honest range after we review your records, never a number to win your business.

Will my case go to trial?

Most cases settle. We prepare every case as if it will go to trial, because insurers pay more when they know we’re ready to.

I was partly at fault. Can I still recover?

Yes. California uses pure comparative fault: your award is reduced by your share of the blame, but you can still recover.
